No. 03353, affirming the Decision dated April 15, 2008 of the Regional Trial Court, Branch 5 of Tuguegarao City, Cagayan, in Criminal Case No. 10516, is REVERSED and SET ASIDE. Appellant Hermanos Constantino, Jr. y Binayug, a.k.a. “Jojit,” is ACQUITTED for failure of the prosecution to prove his guilt beyond reasonable doubt and is ORDERED to be immediately released from detention unless he is confined for another lawful cause.
