WHEREFORE, the Court GRANTS the Petition for Review on Certiorari and the prayer for a Writ of Preliminary njunction. The assailed Decision and Resolution of the Court of Appeals in CA-G.R. SP No. 93227, as well as the Decision of the Regional Trial Court, Branch 105, Quezon City in Civil Case No. Q-0 1-44595, are hereby REVERSED and SET ASIDE. This case is REMANDED to the RTC to hear the issue of ownership for the purpose of just compensation.
