What should I do if a newly built condominium unit wherein the title is still under the name of the developer but the 1st buyer due to unability to pay the arrears wants to transfer the mortgage to me with a deeds of sale, a photocopy of CCT, photocopy of tax declaration (under the name of developer), copy of statement of accounts, and pay him some amount less arrears enough to recover his loses during his payments for 2 years and 5 months. He is working for the company so he able to get a lower interest rate. For me to be able to continue for the same interest rate (12%) for 15 years, he wants to continue the mortgage under his name but we have to sign a Deeds of Sale in favor of me. I would like to re-shorten the mortgage term to 5 years and he say he can arrange it later on. If I will continue the in-house financing but thru my name, the developer may give it to me at 15% int. for 5 years. Would it be ok to continue the mortgage under his name in his company (the developer) since we will have a deeds of sale. I will pay the transfer fees and other charges. Would deed of sale enough for a transfer of the unit?
