Charlene, are you getting a passport and that is the reason you are asking? If so, kindly inquire from DFA. Personally, I do not think there would be a problem.
Hello po atty. Magtatanong lang po. Hindi po me makakuha po ng passport dahil po may discrepancy po sa apelyido ko po. Ang ginagamit ko po ay DELA CRUZ pero sa birth certificate ko po ay DE LA CRUZ po ang nakalagay. Pwede ko po ba ako gumamit ng Affidavit in Discrepancy in name sa pagkuha ng passport po?
Rezalita, contact DFA and ask them kung sufficient na yung affidavit of discrepancy. If not, please go to the nearest Civil Registry office and ask for assistance. Mere misspelling can be corrected administratively, meaning no need to go through the court.

Does the DFA will accept my affidavit of discrepancy po to prove that’s my middle name? kasi blur copy of my middle name of my birth certificate. The LCR said na hindi na ma changed kasi blur na ever since ang copy ko, they suggest na magkuha ng correction of entry but it takes time and i badly needed the passport 🥹

Usually ang affidavit of discrepancy is executed by one who has to explain the discrepancy.

Dan, show your govt issued ids to lto who might issue a driver’s license in your customary name. If they issue driver’s license based on your incorrect name in the birth certificate, just be prepared always with an affidavit of discrepancy in name just in case you will be asked to explain.
Hello po Atty. My parents and my lola will be travelling to sg this coming Sept. 9, sponsored po sila ng tito ko na nagwowork sa sg. (Half brother po ng mama ko), upon checking po sa new guidelines ng immigration re sponsored travels, need po nila iprovide passport, tickets, letter of invitation, and proof of relationship, etc.
Nakakuha po ng passport si mama ko under the name LESLIE, kasi un po ang nasa birth certificate niya so un na po ang sinunod niya. However sa marriage certificate po kasi niya ang name niya na registered is ROSEMARIE, yan po kasi un nakalakihang name na niya eversince, kumbaga yan na po ang ginamit niyang name sa lahat ng records and transactions niya.
Ang question ko po, hindi po kaya magkaproblem si papa ko sa immigration? If hingin ang proof of relationship and ipapakita po ang marriage certificate nila ROSEMARIE ang name ni mama while sa passport and letter of invitation LESLIE. Pwede po kaya iaccept nila if magpapagawa nalang ng affidavit of discrepancy or affidavit of one and the same person?

For sure the immigration officer will notice the discrepancy and will require an explanation. The Affidavit of Descrepancy in Name will explain. But they might require additional documents. Best is if you can find time, go to Immigration and inquire.

Cristina, DFA requires birth certificate for passport issuance. In the case of your child the passport will he issued in her/his name as appearing in her birth certificate. And she/he will always be carrying an affidavit of discrepancy in name in case an explanation is called for.

Christian, I think the validity of their marriage is not affected provided the requisites of marriage are complied with. The identity of your mother can be ascertained by other facts appearing in several documents and can be explained. If affidavit of discrepancy in name is not sufficient correction may be made in the records in civil registry. For this you need to consult with the pertinent civil registry.

Monique, you may have to file a petition in court to have your name changed to Monique from Jennifer. If it is only typographical you may just have it corrected by way of affidavit. Best for you to go to the nearest civil registry and ask for advice.

Leslie, the witness can be anybody who saw the execution or signing of the affidavit. Preferably not related to any of the parties.

Not necessarily, the witnesses. But the affiants must be present before the notary.

Hector, the Affidavit of Discrepancy explains why there is a difference in the names. If the affidavit is acceptable to SSS then you achieve the purpose. If they do not accept the affidavit ask them what document they want so you can get your benefits.

Your name appearing in the birth certificate is your real name, Maria Ana. But when you dealt with Pag-Ibig, they noticed that the name you use is Ma. Ana. Then they ask you why the difference. So you have to explain to them why. Thus, you will compose and sign an Affidavit of Name Discrepancy where you will state that since childhood you have been using the name Ma. Ana and both the names refer to one and the same person, you. Ask Pag-ibig first if such Affidavit is sufficient. I hope it will be sufficient. If Ok, just follow the form provided.

Since birth po kasi ang gamit ko na pong surname ay ang surname ng father ko but then yung sa Birth Certificate ko po pala, ang surname ko po doon ay ang surname ng mother ko, since nung pinanganak po ako year 2002 ay hindi naman sila kasal at may ibang pamilya na rin po ang mother ko ngayon. Kaya sa lahat po ng school records ko po mula elementary hanggang ngayon po, surname po ng father ko ang gamit ko. Gusto ko po sana ipabago yung Birth Certificate ko from surname of the mother to surname of the father. Ano po bang action ang kailangan kong gawin? Hello, atty! same case po kay Dexy, except nung pinanganak po ako eh Legitimate child naman. nagkaerror lang po sa declaration yung parents ko about sa status ng marriage nila dahil may issue noon na akala nila invalid yung unang kasal nila sa judge tapos it turns out na valid pala. Pagpanganak po sa akin sinabi nila na Not married sila kaya po ayun. Lahat po ng records ko apilido ng father tapos sa BC ko surname ko po is kay mother. Hindi ko pa rin po naporprocess since ngayon wala na po akong contact sa both parents ko.
Sapat na po kaya yung Affidavit of Discrepancy para sa graduation requirement? Graduating student na po kasi ako and isa sa requirements yung PSA Live birth namin. Sana po matulungan niyo ako atty. Wala rin po akong ibang valid ids bukod sa barangay ID at school ID.

Christine, I suggest you state in your affidavit of name discrepancy the facts you just stated and attach your birth certificate and validated marriage contract of your parents. The valid marriage contract of your parents justify your use of your father’s surname which you will state in the affidavit. To make correction may take long and you may not have time anymore. Just for graduation purposes. But later approach office of civil registry in your place at patulong kayo re anong gawin.

Kristopher, you may continue using the name you have been using. In case you are asked why your name is different from that appearing in your birth certificate then you execute an affidavit of discrepancy in name.

Hanny, i assume your mother will have to declare you as her daughter so she can get you and you can apply for residency? This would also depend on the authorities in the country where your mother is. Best for your mother to consult a lawyer in that country. An explanation under oath with other documents as proof may be needed. But it would depend on the requirements of that country.

Usually, an affidavit of discrepancy in name refers to the name/s of the affiant, your name, not that of your father.

Gusto ko po sana itanong ang case ng papa ko. Iba ho kasi yung pangalan na nakalagay sa Baptismal Certificate (Alberto) nya at sa NSO Birth Certificate (Roberto). By the way po, late registration po yung birth certificate nya sa NSO kasi wala daw syang record sa local registry office. Tapos yung birthdate nya naman iba ang nakalagay sa school record at sa birth certificate. Tama po lahat ng nakalagay sa birth certificate nya. Pero kailangan po kasi ang baptismal and school record niya sa pag-apply ng visa kasi ‘Late Registration’ ang NSO Birth Certificate nya. Balak ko po sanang kumuha ng passport para sa akin at sa anak ko pero po may problema sa SURNAME ko ng single ko ako instead na Esponilla po ESPANILLA ang nakalagay sa birth certificate ko. Pero po sa MARRIAGE CERTIFICATE KO Esponilla po yung nakalagay hindi po siguro napansin ng Civil Registry na mali apelyido ko sa BC. When you get passport DFA will use as basis your birth certificate. In the same manner, DFA will issue passport for your child based on his/her birth certificate. There could be discrepancy. If ever you are asked to explain the discrepancy later by any agency or entity then you execute an affidavit of discrepancy. Now if you want to have the birth certificates corrected just go the pertinent civil registry and ask for assistance. You will be required to sign a form affidavit.

I do not think there would be a problem or a serious one. US authorities fully know that there are lingual contraptions because of usage. so de la cruz which means “of the cross”, by usage in a place which no longer speak spanish appears in written form as “dela cruz”. The sound is the same. The fault, if ever there is, is DFA who miscopied “de la cruz” to dela cruz. But it is not unexplainable because in the Philippines the name “dela Cruz” is usually used.

Baka hindi pwede. DFA based passport on BC. But just try. I suggest you go to the civil registry near you and ask for the form to be used in correcting typographical error in name. It is only an administrative process.

DFA will based the passport on BC. The result is your friend has a passport with the surname of the mother as his family name. But in all other documents, his family name is that of his father. Then, when asked to explain anytime and anywhere, he must be ready with an affidavit of discrepancy to show and explain.

My passports, school records, SSS ID, and all other identifications ko ay nakapangalan po sa name ko ngayon na Mari Fe Base Balagtas. Since the error is not only typographical, court proceeding is needed to correct the error.
But try again to get a copy of the BC you used for passport etc by making a written request and attach to such request a copy of the BC which you obtained before.

The use of the Affidavit of Discrepancy is to explain why in some documents the name of your brother is Jessie and why in other documents his name is Jesus.
An explanation might be sought for example in this instance. His passport would be based on his birth certificate. So his name appearing in the passport would be Jesus. If he applies of a job abroad he would be required to present his school transcript of records and his passport. His transcripts bear the name Jessie while his passport bears the name Jesus. Thus, he has to present an Affidavit of Discrepancy to explain why. I suggest attached to his Affidavit should be his birth Certificate and his MC. These are official documents which both contain the name of his parents (your grandparents). This is to prove that indeed the name Jesus and Jessie belong to one and the same person.

i suggest from now on use the surname “ramos”, if possible. if you do not have a passport get one and they will issue you with the name appearing in your passport “ramos”. get driver’s license with the surname “ramos”. with these two government issued ids get bank account using the name “ramos”. with passport and driver’s license as your identity, execute an affidavit of discrepancy or affidavit of identity and always keep this with you. if asked why is it that in this or that document your surname is cunanan then present to them said affidavit as an explanation.

i presume your passport is in the name of veronica since passport is based on BC. your problem will arise if you are asked at the seminar to present your passport for identiy purposes. you therefore must execute an affidavit of discrepancy and be ready to present this in case you need to explain. this is the purpose of such affidavit. in some cases you might be asked to present an affidavit of two disinterested persons who has personal knowledge of you. execute also this document so that when needed or required you can present the same.

how about getting a new passport. tell dfa you lost your passport. submit affidavit of loss. and submit your birth certificate. they will issue to you a new passport based on your birth certificate.
i wonder why your passport now does not conform to your birth certificate.

dfa will use the name appearing in the birth certificate. just keep ready the affidavit of one and the same person because you might need it when asked to explain why there is a discrepancy in the name appearing in your passport and that appearing in your other documents.

Good day po. Nais ko po sanang humingi ng advice regarding my school records. Since elementary school years ko po kasi mali yung nagamit ko na year of birth. Dapat po ay 1981, sa school records ko po ay 1982. During my college years, dahil wala kami mahanap na birth certificate, nagpagawa po ang mother ko ng late registration. In that document, 1982 ang year of birth kaya lang mali yung spelling ng surname (maiden name) ng mother ko. So using that document, nagsubmit ako ng personal affidavit at joint affidavit of two disinterested persons sa aking school upang isunod ang middle name ko sa maling spelling ng surname ng mother ko sa late registration birth certificate. Kaya nanatiling 1982 na yung birth year ko at sinunod ko yung maling spelling na surname ng mother ko sa aking school records. After 5 years of working, nakakuha ako ng certificate of live birth dito sa NSO Manila kung saan lumilitaw na 1981 talaga ako ipinanganak at doon tama ang spelling ng apelyido ng mother ko. Naipa-correct ko na po ang PRC, SSS, TIN, at Philhealth records ko alinsunod sa nakuha kong NSO birth certificate. Ang problema ko po ngayon ay ang aking school records. Pwede ko po ba ipawalang bisa yung sinumbit ko dati na personal affidavit at joint affidavit of two disinterested persons on the basis of my NSO certificate of live birth? Ano po ang dapat kong gawin?

I suggest you visit your local civil registrar and ask advice. As I see it the difference is not only typographical. You might need to go to court to have it changed. But please see the nearest local civil registrar and ask advice.

(NSO record shows October 30, 1959 but it should be Oct. 31, 1959). Do you know or suggest any legitimate and accredited agency here in Manila that can issue an Affidavit of Discrepancy for Date of Birth that can suffice the requirement of the US Embassy? I suggest you see the US Embassy on this. They are the ones who will approve. If they say an affidavit of discrepancy is sufficient then you have no problem. Any lawyer can preprare that document but it must be notarized by a notary public accredited by the US Embassy.

Affidavit of Correction lang po yan. Go to the nearest civil registrar and get a form for that purpose. They will advise you how to fill up that form and the subsequent procedure and where to file.

Alfredo, kung jose alfredo sa birth nyo, hindi nyo na po mapalitan nyan. Kung ang gamit ninyo mula noon ay alfredo lang then continue using it. In case you are asked to explain why, then you submit an affidavit of discrepancy showing that jose alfredo danieles at alfredo danieles refer to one and the same person. Pag nag apply kayo ng passport and jose alfredo ang ilagay ng dfa sa passport ninyo kasi depende sila sa kung anong nakasulat sa birth certificate ninyo. palagi lang kayong may affidavit of discrepancy na dala.

I think an affidavit of discrepancy will suffice unless they tell you that you have to submit a Joint Affidavit of Two Disinterested Persons. Why bother two disinterested persons if the affidavit of discrepancy in name due to typographical error would suffice.

Jenny, i suggest you go to the office of the civil registry and ask the procedure for effecting correction of entry in the birth cirtificate. It appears that the error is only typographical. It can be corrected administratively.

carren, if the father signed the back page acknowledging that the child is his, the child can use the family name of the father and therefore magkaroon siya ng middle name which is the surname of the mother.

I suppose this concerns and erroneous entry in your birth certificate. Ask PRC if affidavit of discrepancy is OK with them. If ok you may try to draft one based on the model i provided in my website. Send it to me and I will finalize it.

The name appearing in your passport will be the name that will be written in your passport. What you should do is to go to NSO or to the civil registry to have your name corrected in your birth certificate. An affidavit of discrepancy will not solve the problem.

The error may not be only typographical. In such a case a petition for correction in of entry in the birth cirtificate is necessary. Contact a lawyer friend, if you have one.

Please go to the Office of the Civil Registry where your birth certificate was first filed. They have a form to effect such correction since the discrepancy is just typographical. They will advise you what to do.

una, yung name nyo sa passport ay Maribeth because it is the name appearing in the birth certificate? If so, the descripancy in the name appearing in the marriage certificate and that in the passport and birth certificate can be explained by an affidavit of descripancy. perhaps, they are questionning the contents of the affidavit of descripancy. please scan and email to me and i will email back.
