WHEREFORE, the petition is GRANTED. The February 11, 20 I I and March 6, 2012 Resolutions of the Court of Appeals in CA-G.R. SP No. 05379 are SET ASIDE.

 

Accordingly, the Court GRANTS petitioners’ Motion For Extension Of Time To File Petition For Review filed with the Cou1i of Appeals and gives due course to their Petition for Review. The case is REMANDED to the Court of Appeals for decision on the merits of the petition.

The January 20, 2005 Decision of the Regional Trial Court of Pasig City, Branch 153, and the July 9, 2004 Decision of the Metropolitan Trial Court of Pateros, Branch 73 are REINSTATED and AFFIRMED.
