WHEREFORE, the petition is GRANTED. The February 11, 20 I I and March 6, 2012 Resolutions of the Court of Appeals in CA-G.R. SP No. 05379 are SET ASIDE.

 

Accordingly, the Court GRANTS petitioners’ Motion For Extension Of Time To File Petition For Review filed with the Cou1i of Appeals and gives due course to their Petition for Review. The case is REMANDED to the Court of Appeals for decision on the merits of the petition.

This decision is immediately executory and is without prejudice to the filing of any civil or criminal action against respondent.

 

Let a copy of this resolution be furnished the Bar Confidant to be included in the records of the respondent; the Integrated Bar of the Philippines for distribution to all its chapters; and the Office of the Court Administrator for dissemination to all courts throughout the country.
