As correctly ruled by the CA, the petition for certiorari assailing the orders pertaining to the grant of the TRO and the writ of injunction were filed out of time.  Notice of the issuance of the TRO was received by DBP on the same day it was granted, November 24, 1998; thus, the petition for certiorari should have been filed not later than January 23, 1999.  The denial of the motion for reconsideration of the order granting the writ of injunction, on the other hand, was received by DBP on March 18, 1999 and thus, it had only until May 17, 1999 to file the petition for certiorari.  DBP, however, filed its petition only on June 23, 1999.

Evidently, all the above elements of a cause of action are alleged in the complaint: (1) the legal right of the respondent over the subject property foreclosed premised on the fact that she is the sole heir of one of the owners who is entitled to the right of redemption; (2) the correlative obligation of defendant DBP, as the foreclosing entity, to respect such right of redemption; and (3) the act or omission of the defendant in violation of the legal right, i.e., the act of DBP and its co-defendant Zarate to cause the ostensible foreclosure of the subject property and the subsequent execution of a deed of conditional sale between the defendants even prior to the lapse of redemption period to deprive respondent’s mother of her right over the property.

A cause of action is the act or omission by which a party violates a right of another.[3][24]  A complaint states a cause of action when it contains three essential elements: (1) a right in favor of the plaintiff by whatever means and whatever law it arises; (2) the correlative obligation of the defendant to respect such right; and (3) the act or omission of the defendant violates the right of the plaintiff.  If any of these elements is absent, the complaint becomes vulnerable to a motion to dismiss on the ground of failure to state a cause of action.[4][25]

RESOLUTION

VILLARAMA, JR., J.:

Before us is a petition for review on certiorari under Rule 45 of the 1997 Rules of Civil Procedure, as amended, seeking to set aside the July 21, 2003 Decision[5][1] of the Court of Appeals (CA) in CA-G.R. SP No. 53825 dismissing petitioner’s petition for certiorari.

The antecedents follow:

Corazon Zarate Romero and his brother Gonzalo Zarate co-owned a property covered by Transfer Certificate of Title (TCT) No. 10070[6][2] of the Register of Deeds of Dagupan City.  The subject property, located inDagupanCity,Province ofPangasinan, is a 1,705-square-meter lot with a four-storey hotel erected thereon.

It appears that sometime in 1975, Corazon and Gonzalo obtained a loan from petitioner Development Bank of the Philippines (DBP).  As collateral, they executed a real estate mortgage[7][3] over the subject property in favor of DBP.  On the alleged failure of the two borrowers to pay their amortizations, DBP foreclosed the real estate mortgage onSeptember 15, 1983.  Purportedly, no redemption was made within one year, and thus, DBP consolidated ownership over the subject property.

In March 1993, when Corazon passed away, her sole heir, her daughter respondent Cristina Trinidad Zarate Romero, asserted ownership over the subject property to the extent of one-half thereof.  However, respondent discovered that the property was already registered as early as June 13, 1989in the name of DBP under TCT No. 54142,[8][4] with TCT No10070 in the names of her mother and uncle already cancelled.

Respondent filed before the Regional Trial Court (RTC) of DagupanCitya complaint[9][5] for reconveyance, quieting of title and damages with prayer for a temporary restraining order (TRO) and writ of preliminary injunction to prevent DBP from conducting any auction sale on the subject property during the pendency of the case.  Respondent claimed that her uncle and DBP conspired in committing fraudulent acts relative to their true transaction and concealed the same from her mother, thereby depriving her of her right of redemption.

The RTC, after hearing, issued on November 24, 1998, a TRO[10][6] restraining DBP from proceeding with its scheduled auction of the disputed property onNovember 25, 1998.  The dispositive portion of the trial court’s order reads:

It appearing that plaintiff Cristina Trinidad Romero y Zarate is the sole heir of the late Maria Corazon Zarate Romero[,] co-owner of the ½ pro[-]indiviso of the property covered by TCT No. 10070 which at present is carried in TCT No.54142 inthe name of DBP[,] and to avoid irreparable damage that may arise [from] the auction sale (public bidding) scheduled on November 25, 1998[,] this Court hereby issues a Temporary Restraining Order (TRO) AGAINST DEFENDANT Development Bank of the Philippines, Makati, Metro Manila from proceeding [with] the scheduled auction sale (public bidding) on November 25, 1998 at defendant’s head office at SAM BCG for a period of twenty (20) days from receipt of this order.

SO ORDERED.[11][7]

DBP moved to lift the TRO arguing that it violates Section 2[12][8] of Presidential Decree (P.D.) No. 385[13][9] which prohibits the issuance of a restraining order, temporary or permanent, against government financing institutions like DBP to enjoin any action taken pursuant to the mandatory foreclosure clause of the decree.[14][10]

On December 14, 1998, the RTC denied DBP’s motion to lift the TRO and granted respondent’s plea for an injunctive writ.[15][11] The pertinent portions of the trial court’s order reads:

To the honest evaluation of this Court what is unrestrainable is the right of government financial institutions to foreclose mandatorily all loans with arrearages including interest and charges amounting to at least twenty (20%) percent of the total outstanding obligation.

 To allay the fears of the plaintiff and to avoid any irreparable damage that may arise while the issues involved in the above case are still being resolved and determined by the Court in the light of the evidence so f[a]r presented, [considering that] there is a tendency on the part of the Development Bank of the Philippines of continuing the acts complained of (auction sale/Public bidding) and considering further [that] there [should] be no advantage … given to one [party] to the prejudice of the other while this case is still pending in Court, it is hereby ordered that a WRIT of Preliminary Injunction be issued against defendant Development Bank of the Philippines from conducting any auction sale of the property involved in the above case (formerly covered by TCT No. 10070 and at [present] covered by TCT No. 54142), upon posting  of a BOND by the plaintiff in the amount of P3 Million within five (5) days from receipt of this Order.[16][12]

On even date, DBP moved to reconsider[17][13] the December 14, 1998 Order and at the same time sought the dismissal of respondent’s complaint on the sole ground that the same states no cause of action.[18][14]

On December 23, 1998, the writ of preliminary injunction[19][15] was issued in favor of respondent.

On March 8, 1999, the RTC denied DBP’s motion for reconsideration of the denial of its motion for the lifting of the TRO.  The RTC likewise denied in the same order DBP’s motion to dismiss the complaint,[20][16] and ordered DBP to file an answer.

On March 23, 1999, DBP moved to reconsider the March 8, 1999denial of its motion to dismiss.[21][17]  But even before the RTC could resolve said motion, DBP filed its Answer[22][18] on April 5, 1999.  A manifestation[23][19] was later filed by DBP indicating that the answer it filed was a mere cautionary measure or what is known as an answer ad cautelam and thus without prejudice to any right of action it may take and without any waiver of any of the grounds for the dismissal of the complaint and any favorable resolution or order that a superior court may issue hereinafter.

On April 20, 1999, the RTC issued an order[24][20] denying DBP’s motion for reconsideration of itsMarch 8, 1999 Order.  The RTC in the same order emphasized that DBP already filed an answer thereby rendering the motion to dismiss moot and academic.

On June 23, 1999, DBP filed a petition for certiorari[25][21] before the CA assailing the following issuances of the RTC:

(1)              TRO datedNovember 24, 1998(received by DBP onNovember 24, 1998) issued against DBP enjoining it from proceeding with the scheduled auction sale of the disputed property;

(2)              Order datedDecember 14, 1998(received by DBP onDecember 16, 1998) denying its motion to lift the TRO and granting the respondents’ prayer for a writ of preliminary injunction;

(3)              Order datedMarch 8, 1999(received by DBP onMarch 18, 1999) denying DBP’s motion to dismiss and motion for reconsideration of theDecember 14, 1998Order; and

(4)              Order datedApril 20, 1999(received by DBP onApril 23, 1999) denying DBP’s motion for reconsideration of theMarch 8, 1999order.

In its assailed decision, the CA dismissed the petition on procedural grounds.  It held that the petition questioning the first three orders was filed late as the petition should have been filed within 60 days from receipt of the assailed orders.  The CA noted that as regards the third order, DBP was notified of the denial of its motion for reconsideration of the December 14, 1998 Order on March 18, 1999 and thus only had until May 17, 1999 to question the same.  The CA further stated that DBP’s subsequent filing of its Answer to the complaint rendered its motion to dismiss moot and academic.

Hence, the present appeal.

DBP raises the following issues for this Court’s consideration:

I.          WHETHER … THE COURT OF APPEALS GRAVELY ERRED IN AFFIRMING THE ORDER OF THE COURT A QUO … DENYING DBP’S MOTION TO DISMISS….

II.         WHETHER … THE COURT OF APPEALS GRAVELY ERRED IN AFFIRMING THE ORDER OF THE COURT A QUO … ISSUING THE TEMPORARY RESTRAINING ORDER AND THE PRELIMINARY INJUNCTION AGAINST PETITIONER DBP.

III.       WHETHER … THE RULES OF PROCEDURE [SHOULD NOT] BE APPLIED IN A VERY RIGID AND TECHNICAL SENSE SO AS NOT TO FRUSTRATE THE PROMOTION OF SUBSTANTIAL JUSTICE.[26][22]

DBP insists that it is evident from the face of the complaint that respondent failed to state a cause of action.  DBP contends that respondent’s allegation of conspiracy between DBP and Gonzalo is bare and has no factual basis to stand on.  Further, DBP claims that respondent has no legal right over the subject property as she did not inherit the same in the first place.  At the time of death of respondent’s mother, the property was not anymore owned by the latter and therefore not part of her estate.  Thus, respondent has no legal right over the property and has no cause of action against DBP.  And because she had no right to the property, the issuance of the TRO and injunctive writ were likewise improper.  DBP also points to the following provisions of P.D. No. 385 that were allegedly violated with the issuance of the TRO and injunctive writ:

Section 1.  It shall be mandatory for government financial institutions, after the lapse of sixty (60) days from the issuance of this Decree, to foreclose the collaterals and/or securities for any loan, credit, accommodation, and/or guarantees granted by them whenever the arrearages on such account, including accrued interest and other charges, amount to at least twenty percent (20%) of the total outstanding obligations, including interest and other charges, as appearing in the books of account and/or related records of the financial institution concerned.  This shall be without prejudice to the exercise by the government financial institutions of such rights and/or remedies available to them under their respective contracts with their debtors, including the right to foreclose on loans, credits, accommodations and/or guarantees on which the arrearages are less than twenty percent (20%).

Sec. 2. No restraining order, temporary or permanent injunction shall be issued by the court against any government financial institution in any action taken by such institution in compliance with the mandatory foreclosure provided in Section 1 hereof, whether such restraining order, temporary or permanent injunction is sought by the borrower(s) or any third party or parties, except after due hearing in which it is established by the borrower and admitted by the government financial institution concerned that twenty percent (20%) of the outstanding arrearages has been paid after the filing of foreclosure proceedings.

Respondent, for her part, counters that the CA was correct in dismissing the petition for certiorari for having been filed beyond the sixty (60)-day reglementary period.  Also, respondent contends that the provisions of P.D. No. 385 relating to the proscription against the issuance of injunctive writs enjoining foreclosure sales are not applicable in the instant case.  She points out that what the RTC enjoined is not an auction sale arising from the foreclosure of mortgage as the subject property had long been foreclosed and title thereto consolidated in the name of DBP.  Rather, what the RTC enjoined was DBP’s sale of the subject property through ordinary public bidding which is not within the ambit of P.D. No. 385.

The petition should be denied.

As correctly ruled by the CA, the petition for certiorari assailing the orders pertaining to the grant of the TRO and the writ of injunction were filed out of time.  Notice of the issuance of the TRO was received by DBP on the same day it was granted,November 24, 1998; thus, the petition for certiorari should have been filed not later thanJanuary 23, 1999.  The denial of the motion for reconsideration of the order granting the writ of injunction, on the other hand, was received by DBP on March 18, 1999 and thus, it had only until May 17, 1999 to file the petition for certiorari.  DBP, however, filed its petition only onJune 23, 1999.

As to DBP’s motion to dismiss the complaint, we agree with the RTC and CA that the same should be denied, but not for the reason cited by said courts that it has been rendered moot and academic by DBP’s filing of its answer but because the same lacks merit.  Contrary to DBP’s submission, a perusal of the allegations of the complaint clearly reveals respondent’s cause of action against DBP.  The complaint states,

1.1  Plaintiff is the sole heir and successor-in-interest of the late Ma. Corazon Zarate-Romero, who died intestate on6 March 1993.

3.  During her lifetime, plaintiff’s predecessor-in-interest was the erstwhile owner pro-indiviso of that parcel of land, together with improvements, located in Dagupan City, which property used to be covered by Transfer Certificate of Title (TCT) No. 10070 of the Registry of Deeds of Dagupan City….

4.  In or about the year 1975, defendant Zarate, who was co-owner of the subject property, secured various personal loan obligations from the defendant DBP in the aggregate amount of P2,000,000.00.

4.1  To secure such putative loan obligations of the defendant Zarate, the latter, who wielded moral ascendancy over his younger sister and herein plaintiff’s predecessor-in-interest — Ma. Corazon Zarate-Romero, cajoled and prevailed upon the latter to mortgage the entirety of the subject property in favor of defendant DBP, including her one-half (1/2) pro-indiviso share in the same.

4.2  Accordingly, defendant Zarate assured the plaintiff’s predecessor-in-interest that the mortgage would be for a brief period only and that he (defendant Zarate) would forthwith pay and settle in full all his personal loan obligations with the defendant DBP to ensure that said mortgage is cancelled in the soonest time possible.

5.  At some point in time during the effectivity of the mortgage, however, defendant Zarate apparently saw an opportunity to claim the entirety of the subject property for himself, to the exclusion of plaintiff’s predecessor-in-interest.

5.1  Emboldened by, and taking advantage of, the complete trust and confidence reposed upon him by the plaintiff’s predecessor-in-interest anent the subject property, defendant Zarate conspired with the defendant DBP for the ostensible foreclosure of the subject property, with the end in view, however, of subsequently reacquiring the same for himself as sole owner.

6.  Pursuant to such sinister plot hatched by defendants, defendant DBP foreclosed the subject property in September of 1983 and, thereafter, bought the same for itself in the sum of P2,253,101.00 during the auction sale conducted by the Deputy Sheriff of Pangasinan….

7.  Significantly enough, and even before the lapse of the mortgagors’ right of redemption over the subject property, the herein defendants entered into a Deed of Conditional Sale over the same, with the defendant DBP as seller, and the defendant Zarate as buyer….

7.1  Needless to state, all the aforedescribed dealings, transactions and proceedings concerning the subject property — from its fraudulent foreclosure up to the highly anomalous execution of the Deed of Conditional Sale over the same — were concealed from plaintiff’s predecessor-in-interest and even from the plaintiff herself after the death of her mother.

Evidently, all the above elements of a cause of action are alleged in the complaint: (1) the legal right of the respondent over the subject property foreclosed premised on the fact that she is the sole heir of one of the owners who is entitled to the right of redemption; (2) the correlative obligation of defendant DBP, as the foreclosing entity, to respect such right of redemption; and (3) the act or omission of the defendant in violation of the legal right, i.e., the act of DBP and its co-defendant Zarate to cause the ostensible foreclosure of the subject property and the subsequent execution of a deed of conditional sale between the defendants even prior to the lapse of redemption period to deprive respondent’s mother of her right over the property.

WHEREFORE, the petition is DENIED for lack of merit.  The Decision dated July 21, 2003 of the Court of Appeals in CA-G.R. SP No. 53825 is AFFIRMED.

No costs.

                In case a restraining order or injunction is issued, the borrower shall nevertheless be legally obligated to liquidate the remaining balance of the arrearages, paying ten percent (10%) of the arrearages outstanding as of the time of foreclosure, plus interest and other charges, on every succeeding thirtieth (30th) day after the issuance of such restraining order or injunction until the entire arrearages have been liquidated.  These shall be in addition to the payment of amortizations currently maturing.  The restraining order or injunction shall automatically be dissolved should the borrower fail to make any of the above-mentioned payments on due dates, and no restraining order or injunction shall be issued thereafter.  This shall be without prejudice to the exercise by the government financial institutions of such rights and/or remedies available to them under their respective charters and their respective contracts with their debtors, nor should this provision be construed as restricting the government financial institutions concerned from approving, solely at its own discretion, any restructuring, recapitalization, or any other arrangement that would place the entire account on a current basis, provided, however, that at least twenty percent (20%) of the arrearages outstanding at the time of the foreclosure is paid.

                All restraining orders and injunctions existing as of the date of this Decree on foreclosure proceedings filed by said government financial institutions shall be considered lifted unless finally resolved by the court within sixty (60) days from date hereof.

How to sell the beauty of thePhilippinesto the world is very much in the mind of newly appointed Tourism Secretary Ramon Reyes Jimenez Jr. who—the ad man that he is—said on Thursday that it “should be as easy to sell as Chickenjoy.”

Jimenez shared his ideas—some of them catchy slogans—on how he plans to go about making the best sales pitch for the country when he faced the media for the first time on Thursday just a few hours after President Aquino confirmed in China where he is on a state visit—that he indeed has chosen the top advertising executive to head the Department of Tourism (DoT).

Since the Aquino administration came to office last year, it has yet to come up with a tourism slogan to promote thePhilippines to the world.

“The Philippinesshould be as easy to sell as Chickenjoy,” Jimenez said, in referring to a wildly popular menu fare at food giant Jollibee.

President Aquino announced Jimenez’s ascent to the DoT a day after Alberto Lim’s resignation from the top DoT post became effective.

Lim was in the Palace on Thursday in a news briefing to formally introduce Jimenez, whose day job since last week was chief executive officer of Jimenez Basic as well as CEO and senior consultant at WOO (for Winning Over Obstacles) Consultants.

“This is the most beautiful country in the world. Or you can say we are one of the top 10 most beautiful countries in the world. There is no reason we won’t succeed,” Jimenez said as he faced the media for the first time after Mr. Aquino confirmed he was the man he had chosen to replace Lim.

Jimenez said that in taking the job, he was aware that he would succeed “only if I begin by rallying the DoT staff, the team, tourism practitioners, the government bureaucracy and the general public around one very simple idea—tourism is the people’s business,”

He stressed the ultimate goal was “not merely to improve statistics on tourist arrivals” but “to generate fulfilling and profitable income and employment for our people.”

Jimenez said his marching orders was to make tourism “the people’s business.”

“We have no business in engaging in this industry if it’s not going to benefit our people,” Jimenez said.

“In fact, job No. 1 is to galvanize the DoT staff into an honest-to-goodness selling unit. After all, selling is our job. We are actually salesmen.”

Consultative style

Founder of one of the most successful advertising agencies in the country, Jimenez is known in the industry as “Mon J,” a humble man whose “consultative” style helped his firm market some of the most iconic brands today.

As head of the advertising firm Jimenez Basic, he helped build up products of companies ranging from San Miguel Corp., Globe Telecom, Unilab, Chowking, Coca-Cola, Cebu Pacific—and Jollibee, one of whose best-selling food items is Chickenjoy.

Asked where his confidence in being able to sell thePhilippineswas coming from, Jimenez said thePhilippines“is an obviously beautiful product.”

“ThePhilippinesshould be as easy to sell as Chickenjoy,” he said, stressing that some people probably had difficulty selling the country “because maybe our approach is not simple enough.”

“The best marketing communications campaigns anywhere in the world are rally hinged on the simplicity of a proposition.”

Jimenez saidMexicohad become a major tourist draw “because the image ofMexico, even now in your minds, is very clear. You can see the tacos and the hats and the ponchos.”

“You’ve got to work and think hard about what the proposition is. And then everyone else’s focus is on selling that. That’s how it works.”

In announcing that Jimenez had accepted the job, the President stressed the importance of marketing the country to foreign tourists.

“At the end of the day, he will be informing a lot of the citizens of the world that there are such and such sites accessible, it should be visited,” Mr. Aquino said.

“I want to see him by next week and I assume there will be things that he wants done,” he added.

Mr. Aquino said that for the time being, he believed Jimenez “would be maintaining the bureaucracy at the DoT.”

Road to prouder future

“The President looks forward to the growth of (the tourism) industry and to the improved global profile of many of our country’s tourism destinations,” Communications Secretary Ricky Carandang said to introduce Jimenez to the Palace press corps.

He said Jimenez had been in marketing communications for 35 years and called him “one of the pillars of Philippine advertising.”

Thanking President Aquino for his “trust and confidence” in him, Jimenez vowed to do his best “to make tourism a hallmark of his administration’s drive to bring our people to the road, to richer and prouder future.”

He underscored the need to “get the product itself to believe in itself” because by making Filipinos “excited about tourism, then they will in fact attract the world.”

Jimenez intended to meet today with tourism officials, saying “the selling cannot begin soon enough.”

“When you think about it, it’s not really what we think about our own campaign. It’s what the world will think about it,” Jimenez said.

“ThePhilippineshas to have a competitive campaign based on a proposition that offers people real value for their time and their money,” he said.

Compelling idea

“Let’s take the extreme. What do you have to say to someone who lives about 6,000 kilometers away inNorwayfor him to come all the way here to see some goldfish under the sea? You have to have a very single-minded proposition that comes alive in his head, in his mind.”

The key, Jimenez said, was to “find a proposition that is compelling enough and competitive enough.”

He acknowledged it was tough to come up with a “single slogan” or to “capture (the idea) in three or four words.”

Indeed, it was this kind of approach that Jimenez said he took when he helped in the presidential campaign of Mr. Aquino.

Jimenez made it clear that the vision of “Daang matuwid (straight path)” was Mr. Aquino’s  from the start.

“All we did was transform it into a single-minded idea that compelled people to vote for him… So that’s how communication works. You have fundamentally the core truth and somebody turns it into a proposition people cannot refuse. That’s how it works and hopefully that’s what I will be able to do,” he said.

Spain’s example

Jimenez said he was hoping to convince the tourism sector “to dream about what we can have tomorrow.”

Asked what country in the world he thought was able to promote itself to the world successfully, Jimenez citedSpainas an example.

He said people inSpainwere the owners of the tourism industry.

“It belongs to the people,” he said.

“They cook for the tourist. Cooking there is a business. It’s not about you frying banana cue and considering it only as a job for you,” he added.

Even business leaders with jaded views about DoT’s past performance were all praise for Jimenez.

“I’ve known Mon Jimenez as a professional and a gentleman,” said Management Association of thePhilippines president Felino Palafox Jr. “He is a good ‘people person’ who is consultative and humble, despite his successful career.”

A visionary

In 2009, advertising industry publication Adobo magazine featured Jimenez and his wife, Abby, crediting the couple for building “the most profitable creative agency inManila.”

“[Jimenez Basic] has a solid reputation for creative and effective ads that find their way into people’s conversations,” the magazine said. “Employee turnover is one of the lowest in the industry, shored by good compensation, reasonable work hours and annual company outings abroad.”

Other clients in Jimenez Basic’s portfolio included Innove, Citibank, Sara Lee, Meralco and Nutriasia Foods.

Tourism industry advocate Robert Lim Joseph described Jimenez as a “visionary.”

For almost two decades, Jimenez was CEO of Jimenez Basic Advertising (1989-2008). He was also vice president and executive creative director at Ace-Saatchi & Saatchi Advertising and associate creative director at Ace Campton Advertising.

He is married to Annabelle Lee Jimenez, who also sits as CEO of WOO Consultants. They have two children: Nina, an associate creative director and copywriter; and Melissa, a fashion designer known as “Sassa.”

(SPOT.ph) President Noynoy Aquino has appointed advertising exec Ramon “Mon” Jimenez Jr. as the new Tourism Secretary, reports ABS-CBN News. Jimenez replaced business mogul Alberto Lim, whose resignation became effective yesterday, August 31.

“He’s a marketing, advertising guy and tourism I think is primarily a marketing effort because the product is already there,” Aquino told reporters during his China visit. “Merong enhancing the product that we have in the Philippines and at the end of the day, he will be informing a lot of the citizens of the world that there are such and such sites accessible, it should be visited.”

Jimenez graduated with a Fine Arts degree from the University of the Philippines. According to Sun Star, he is the founder and president of marketing agency Winning Over Obstacles (WOO) Communications Corp., which helped with Aquino’s presidential campaign. He also founded leading ad agencies Jimenez & Partners, Jimenez D’Arcy, and Publicis JimenezBasic.

Beijing(via PLDT) – President Benigno Aquino III has appointed advertising executive Ramon Jimenez Jr. as Tourism Secretary.

“He is a marketing guy, and tourism is a marketing effort. The product is already there. At the end of the day, he will be informing a lot of citizens of the world that there are such and such tourism sites in the Philippines and these are accessible and should be visited,” Aquino said in a tete-a-tete with the media Wednesday night.

Jimenez was the brains behind Aquino’s “sangang-daan” election campaign material last year that showed the then presidential candidate urging the nation to join him in treading the straight path and leave behind the crooked ways of the past.

A Fine Arts graduate from the University of the Philippines, Jimenez was the founder of advertising firm Publicis before forming WOO (Winning Over Obstacles) Consultancy Inc. in 2008.

He was also a former vice president of Ace Saatchi & Saatchi Advertising in the 1970s.

His predecessor, businessman Alberto Lim, resigned as tourism chief last month, citing his need to spend more time with his family.

“I will not be submitting his name to the Commission on Appointments if I don’t think he can equal or exceed the accomplishments of Secretary Lim,” Aquino said.

Aquino said he will meet with Jimenez next week after his five-day state visit here in the mainland to discuss the priority programs in the Department of Tourism.

The President, however, said he was not keen on appointing Lim as a member of the Central Bank’s Monetary Board out of respect for the latter’s desire to have more quality time with his family.

Tan Cheng Bock (simplified Chinese: 陈清木; traditional Chinese: 陳清木; pinyin: Chén Qīngmù; Pe̍h-ōe-jī: Tân Chheng-bo̍k; born 26 April 1940) is a politician and physician from Singapore. Tan was a People’s Action Party (PAP) Member of Parliament in Singapore politics for 26 years (1980-2006) and the first non cabinet minister elected into the People’s Action Party Central Executive Committee (1987-96).

 

Early life

Tan was educated at Radin Mas Primary School and Raffles Institution, before going on to study at the University of Singapore where he graduated with a Bachelor of medicine and surgery (MBBS) in 1968. [1] He was a backbencher in Singapore’s Parliament from 1980 to 2006 as a member of the People’s Action Party (PAP). In early May 2011 he resigned from the PAP to stand as a candidate in the 2011 presidential election. [2]

Medical career

Tan has been the Medical Director of Ama Keng Medical Clinic in Jurong since 1971. He has served as the Chairman of the Society of Private Practice, as a Council Member of the College of General Practitioners, as Committee Member on the Council of the Singapore Medical Association, as Chairman of the SMA Trust Fund, as Board Member of SMA’s Ethics Committee, as SMA’s Representative on the Ministry of Health’s Committee on the Regulation of Medical Clinics, and as a Part-time clinical teacher in General Practice at National University of Singapore. [1]

Political career

Representing the PAP, Tan was elected as a Member of Parliament for Ayer Rajah SMC at the 1980 general election (83% majority). He was re-elected five times in 1984 (75%), 1988 (70%), 1991 (75%), 1997 (73%) and 2001 (88%), winning by an average majority of 77%.[3][4] His 88% share of the vote in the 2001 parliamentary elections was the PAP’s best score in 31 years. [5]

While in Parliament, he served as the Chairman of the Government Parliamentary Committees (GPCs) for Education (1987–90), National Development (1991–95) and the Environment (1995–97), and was the Co-ordinating Chairman for all GPCs from 1987-88. He was also a member of the GPCs for Communications (1997–2000) and Defence & Foreign Affairs (2001–06). Tan was the Leader of the Singapore-European Parliamentary Group between 1991 – 1996 and Singapore-SEA Parliamentary Group between 1997 – 2006. From 1987 – 1996, he was an elected member of the PAP Central Executive Committee[4], the highest ruling committee within the PAP. Tan stepped down as a Member of Parliament at the 2006 general election. He also served as Chairman of the Jurong East Town Council from 1989–91, Chairman of the West CoastAyer Rajah Town Council from 2001–04, Chairman of the Bukit Timah Community Development Council from 1997–2000, and Chairman of the Feedback Unit at the Ministry of Community Development from 1985-89.

CPF for Tertiary Education

In 1988, Tan Cheng Bock, as GPC Chairman for Education, led a team of MPs to argue for the use of CPF for education, as an appreciable number of able students were not able to enter local universities due to limited places. Tan felt that education was a form of investment, and that all his GPC was asking for was an extra option for CPF members, to let them decide whether to put their investible savings in stocks and shares or in education. Chief argument against the idea was that the use of such retirement savings may leave the account holder with an insufficient amount at the end of his working life. The Minister for Labour at that time, Lee Yock Suan said that there were alternatives available such as soft loan schemes which were interest free. In answer to Tan’s claim that Lee had not clearly stated his position on the issue despite the idea being first mentioned years ago, Lee insisted that his position had always been plain, that he “was against it, but you have pressed me to study it and I shall”[6]. The set of guidelines on the use of CPF for Education proposed by the GPC was eventually implemented, paving the way for the beginnings of a wave of Singaporean students studying at local tertiary institutions. [7]

Free parking

Tan also convinced the Ministry of National Development (MND) to let Singaporeans park their cars for free in HDB estates on Sundays and public holidays, to promote family togetherness.[citation needed]

In early 2010, Tan volunteered himself to help fellow multi-millionaire residents in Sentosa Cove to meet with Sentosa Development Corporation (SDC) to seek waiver of the gantry entry charge (S$2 to S$7 depending on the entry time) for visitors to their residences to the Sentosa island. His efforts however did not bear immediate fruits. Later in October 2010, the SDC offered to cap the entry charge at a concession rate of $3.[8]

Nominated Member of Parliament Scheme

Tan Cheng Bock actually voted against his own party despite the Whip not lifted (a first in the history of Singaporepolitics) regarding the NMP scheme, on grounds that MPs had to be elected by the people and be accountable to an electorate for their views. He received a warning for his action.[9]

Think Singaporeans First

In 1999, when the nation was recovering from the Asian Financial Crisis, and experiencing yet labour talent shortages in several key sectors, the PAP pushed for a stronger intake of foreign talent to fill the ranks. Although not against this rationale, Tan Cheng Bock argued that the Government should tone down its calls for the recruitment of foreign talent and reassure Singaporeans that they came first, [10] which earned him strong rebuttals, including one from then Minister of Trade and Industry BG Yeo and a stern rebuke from then Senior Minister Lee Kuan Yew.[11]

No Blank Cheque

In 1985, he made in Parliament about “no more blank cheque” for the ruling party which he revisited on his blog in May 2011.[12][13]

Working with the Opposition

After the May 2011 General Elections, Tan said in a speech at the 52nd Singapore Medical Association Annual Dinner that he had given advice to Opposition candidates including Tan Jee Say on how to campaign in the 2011 general elections when they approached him. [14][15] Tan Jee Say had stood for election as SDP candidate in Holland-Bukit Timah GRC and lost. Tan Jee Say later resigned from his party to stand in the 2011 presidential election.

Business Career

Appointment to Chuan Hup

Tan’s appointment as non-executive Chairman of Chuan Hup Holdings Ltd in 1991 was unusual at the time, as Members of Parliament did not normally hold such positions. Prime Minister Goh Chok Tong, who had been a classmate of Tan’s at the Raffles Institution (Secondary), later said that he had initially been inclined to say no to Tan’s request because Tan was a medical practitioner with no experience in shipping:

“When I first saw the letter, the old attitude was, why is the company interested in him? Is it to use him to open doors in Singapore? People know that he was my classmate. He is close to me. And would they use him to take advantage of his relationship with me? I would regard that as natural initial reservations.”[16]

Goh ultimately agreed to the appointment, but in the letter he sent to Tan made clear his reservations:

“When you become CHH’s non-executive chairman, you should distinguish clearly between your private position as CHH’s chairman and your public position as MP. You should not lobby any public officer in the course of your business. You have often spoken publicly on the state of the property market, and the need for the Government to intervene. It has not always been clear whether you were speaking as an MP, or in your private or professional capacity. This has confused the public.”[17]

Goh later confirmed that neither Tan nor his company had ever tried to take advantage of his position.[16]

2011 Presidential Election

In June 2011, Tan announced that he was running for the position of President of Singapore in the 2011 presidential election. He resigned from the party early May 2011 in order to be able to stand for the Presidental election (as members of political parties are barred from running for the office of President).[18][2] On 22 July 2011, Tan submitted the presidency forms. [19] On 11 August 2011, Tan was declared eligible to run.[20]

Internal Security Act detentions

Controversy erupted shortly after Tan declared his interest in the Presidency. It was revealed that in a Straits Times article dated back in 1987, Tan had spoken regarding the Singaporean government’s controversial Operation Spectrum while he was in parliament, which saw 22 young Roman Catholic church and social activists and professionals detained without trial.[22][23] He addressed in his capacity as Feedback Unit chief, that most Singaporeans had accepted the government’s and ISD’s reasons for the detention, he also reported that certain “solid citizens” were sceptical of the detention. On 4 June 2011, Tan’s Facebook administrator cited that as posts on his page about the incident were running contrary to what law courts have ruled, the risk of being sued for defamation was open to both hosts of the site and people behind the posts alike, as such, “(they) are obliged to remove posts that run contrary to what the law courts have ruled.”[24] In an interview with The Online Citizen geo-political website in June 2011, Tan explained[25] why he ‘supported’ the infamous detention, “I believed the information that was given to me from the government at that time. I saw that the people believed that they were conspirators as well. As Feedback Unit Chief, I could not let my own feelings dilute the general consensus, which I presented in Parliament.” When asked whether he still feels the ‘Marxist conspirators’ are guilty, Dr Tan responded, “I really feel they are innocent. They are all social workers and they meant well but unfortunately”.

In the presidential candidate broadcast,[26] Tan addressed that “The President must be above politics.” and that “he must not be a proxy to be any political party” where “his interest must be national, not with a political agenda in mind”.

He also proposed for the government and the Prime Minister’s office to be separated as “this familiarity attracts unwanted suspicion of undue influence”. He emphasized that this separation is a symbolic move required to reassure the people that they are independent of each other.

Tan also proposed an Annual Statement for greater transparency in order for Singaporeans to better understand the president’s activities and ideas in unifyingSingapore. The statement will also touch onSingapore’s reserves, and the rationale behind the appointment or vetoing of civil servants.

Tan’s campaign slogan is “Think Singaporeans First”, a reference to his 1999 debate on the need to prioritize Singaporeans first when faced with prevailing foreign talent policy.[26]

Election symbol

Tan’s symbol is a palm tree. He explained “The leaves of the palm represents our multiracial society, the trunk represents them coming together, and the roots represents us taking root in Singapore.” [27]

All about Dr Tan Cheng Bock

From village doctor, to member of parliament, to corporate world, charities, and the grassroots.

A man driven by passion:

 

Tan Cheng Bock is a man who went from humble beginnings to a varied and deep experience. Born in 1940 to a poor family,whose father passed away in his mid-teens,he went through Raffles Institution on bursaries,eventually making it through to medical school inSingapore to qualify as a medical doctor. He began working life in equally humble circumstances,in 1971,as a village doctor in Ama Keng village,Lim Chu Kang. Described as “the best years of my life”,where life was so simple and real as to take payment sometimes in vegetables and farm produce;he came to be the confidant of the villagers,who looked to him to represent them in matters with the authorities. Eventually this brought him to the attention of the PAP which asked him to stand for general elections in 1980.

 

Parliamentary Contributions

As Tan Cheng Bock entered the political arena in 1980,it became clear that his strength was in the grassroots,with the people. He became Chairman of the Feedback Unit (84-89) and was so effective and sincere in conveying the people’s hearts that he was nicknamed Mr. Feedback. He spoke vigorously but fairly in parliament for the people,for moderation in certain government policies which he felt were divisive and elitist,including streaming in education (’81),graduate mothers programme,and the excessive emphasis on foreign talent (‘99). On one occasion,disagreement even came to the point of voting against his own party,the PAP,on the Nominated MP scheme (‘92) which he felt violated a principal of democracy:which was,to speak in parliament requires electorate accountability. Tan Cheng Bock’s motto has been “Let your conscience be your guide”, as sometimes what is right should prevail over party lines. He also advocated policies which he felt were for the common man,including leading successfully the fight for CPF for Education,Free Parking on Sundays to promote social interaction,more C class hospital beds,greater access for the disabled,and more affordable primary healthcare access. As the people grew to know him as an MP with a heart for the common man,and a defender of principles and values,he became fondly known as “Doc” to the people ofSingapore.

Political & Foreign Appointments

His frankness over policy won him respect within the PAP,such that from 1987-96,he was an elected member of the Central Executive Committee of the PAP,its highest ruling committee.  In 1985,he was the pioneering 1st Chairman of Town Councils,he was to helm various town councils all the way to 2004.  In 1987,he also became Co-ordinating Chairman of all Group Parliamentary Committees – GPCs propose and assess policy flowing from the ministries. His involvement in GPCs spanned from Education (Chairman),National development (Chairman),Environment (Chairman),Communications (Member),to Defence &Foreign Affairs (Member). Tan Cheng Bock’s warm personality also saw him involved inSingapore’s foreign relations for 15years,where he was Leader of the Singapore-Europe Parliamentary Group (91-96),and subsequently forSouth East Asia (97-2006). During this leadership,his duty was to visit,and receive visiting parliamentarians from these countries,and others as well. Dignitaries met include Mahathir,Najib,Megawati,Ramos,Deng Xiaoping,Zhao Zhiyang,Nakasone and others. One of his foreign affairs highlights was to actually help guide the first general elections ofCambodia whilst the political atmosphere there was still charged with violence.

Corporate Governance

His reputation for accountability and independence, brought him to the attention of the corporate world where he has held various positions of Corporate Governance. He has been Chairman of Investment holding company Chuan Hup since 1991,and was invited to be an independent board member of the Asia Pac operations of two multi-billion European multi-national companies –Dredging Int’l Asia Pac since 1997 (of the DEME Group) and ING Asia Private Bank (of ING N.V.),which later became Bank of Singapore. From commercial entities,he also advised charities as well,including the Disabled People’s Association (85–06),Handicap Welfare Association (86–06) and Credit Counseling Singapore (02-07). He also has a long history in statutory boards,having been a board member of Mass Rapid Transit Corporation (83-85),SMRT (87-95),Land Transport Authority (95-05). Recently in March 2011,another incident impinged on his conscience which caused him to resign from the board (Jurong Medical Centre) of the upcoming Ng Teng Fong Hospital,where he did not believe that a 90% publicly funded institution should give up its entire naming rights (originally Jurong General Hospital) on a 10% donation.

Grassroots & Community

Despite the many high appointments,Tan Cheng Bock never forgot the ground and he loved the ground,this was his base,and constituents of Ayer Rajah remember him fondly for being an accessible,warm,and fair MP. He promoted social interaction,integrated Community Centres for young and old to mix,pioneered disabled access,and genuinely enjoyed gracing community events. His heart for the grassroots was such that he named the community centre theatre after a simple humble grassroots leader who never sought high appointments,Pek Ang Mooh,a tribute plaque written by Tan Cheng Bock himself can be seen there today. Ayer Rajah gave Tan Cheng Bock a resounding send off in the 2001 GE at 88%,his average being 77% over 6 general elections fought,in what was to be his final term,retiring in 2006,after 26 years of service.
